千田有紀氏記事の問題点・米国家裁の新ガイドラインは家裁はDV被害者に虐待の責任を負わせるのではなく協力するよう求めている件

この件。

上記記事中で千田氏は、アメリカの「少年家庭裁判所の裁判官たちのガイドラインの改定で」子どもが(面前)DVに晒されるのに止められなかった場合には、「虐待やネグレクトの加害者」とされることになったのだ。」と主張しています。
その事例としてあげているのが、 Robert Braxton Jr.事件と Alonzo Turner 事件で、いずれも2006年の事件です。ところが千田氏のいう「少年家庭裁判所の裁判官たちのガイドラインの改定」は2016年です*1
ですから、千田氏記事におけるRobert Braxton Jr.事件と Alonzo Turner 事件の事例について以下のように評している部分は時系列が矛盾しており明らかに間違っています。

そんな馬鹿な、酷い、と思うが、 少年家庭裁判所の裁判官たちのガイドラインの改定で、殴られている女性は、被害者ではなく、子どもの養育者として位置づけることが決まった。子どもが(面前)DVに晒されるのに止められなかった場合には、「虐待やネグレクトの加害者」とされることになったのだ。このことで多くの被害者が、深く傷つきトラウマとなっている(Moms Are Going to Jail When Abusive Partners Hurt the Kids)。

そもそも千田氏は上記記事の記載に際し、参考としてMoms Are Going to Jail When Abusive Partners Hurt the Kidsを挙げていますが、その引用先では上記ガイドライン改定をむしろ肯定的に評価しています。

And that’s just the criminal consequences of outdated “failure to protect” laws that don’t take intimate partner violence into consideration. Even if a mother isn’t sentenced to prison, she could very well still lose access to her child should a family court feel she failed to protect them.

Fortunately, new guidelines are urging family courts to work with survivors rather than hold them accountable for abusers’ actions.

参照先の記事では、要するにRobert Braxton Jr.事件と Alonzo Turner 事件でDV被害者が不当な刑罰を科されたことについて、DVを考慮せずに「保護の失敗」をもたらした時代遅れの法律による弊害が刑事罰の面で表出したものだと指摘しており、新ガイドラインに対しては、幸いにもDV被害者に虐待の責任を負わせるのではなく協力することを家裁に求めていると好意的に評価しています。

したがって、千田記事は2016年の新ガイドラインに対しての理解を欠いたもので、引用しているサイトとはむしろ逆の意味づけを与えているという他なく、その意味でも間違いです。
はっきり言って虚偽の内容で2016年新ガイドラインを貶めているとさえ言える記事で、かなり問題あると思います。

虐待加害者であったRobert Braxton Jr.の刑罰が軽かった(懲役10年8年免除で実質2年)のは、DV被害を受けていたTondalo Hall が十分に証言できなかったことが大きな要因と言え、そのため、Robert Braxton Jr.の容疑は1人の子どもに対する虐待のみとなった経緯があります。このときの検察官 Angela Marsee はTondalo Hallが十分に証言しなかったことに不満を抱いたようで、Robert Braxton Jr.の判決後に始まったTondalo Hallに対する審理で極めて厳しい態度を採っています。

The report noted that Hall was 22 years old, had no prior arrests, and suffered from depression. The report recommended a “split sentence,” which means some time in prison and some on probation. If released to probation, the officers said, “She would be supervised as a low-level offender.” Marsee, the prosecutor in both the Braxton and Hall cases, said in court that she had no issues with any of the facts in the report.

Hall’s sentencing hearing began on Dec. 20, 2006, two weeks after Braxton was released. Marsee called for Hall to spend “a significant portion of the rest of her life” in prison. “She's their mother,” Marsee told the court. “She is the one person in this world who should be standing up for them,” she said, yet “they were in pain because of what she didn't do, and she should pay for that."

Marsee also had another reason for recommending a long sentence: Hall, she declared, was part of the reason the case against Braxton “fell apart.”

“He definitely should have received a more significant sentence,” Marsee told the court, “but because of her minimizing and continuing to protect herself and protect him, that had a real impact on what we were able to do with him in the jury trial. So she should not benefit from that.”

この辺りの経緯を見ているとAngela Marsee検察官によるTondalo Hallに対する八つ当たりとも取れます。

When it came time for Judge Ray Elliott to announce his decision, he told the courtroom that he had noticed some things about Hall’s testimony. After certain questions, Hall would “make direct eye contact” with Braxton before “taking a moment or two to respond.”

“That tells me something, based on my years of experience,” Elliott said. But this did not excuse her. “Was she scared of him? Probably,” he said. “But, again, even weighing that factor into the equation I’m of the opinion she was less than candid.” He sentenced her to 30 years in prison.

その後のRay Elliott裁判官の対応も大概で結局懲役30年という判決に至っています。

言うまでもないのですが、この事件は離婚後共同親権だから起きたわけでもなんでもなく、“子どもを監護している親には子どもを守る責任がある”という大前提を一方の親が他方の親を虐待している場合でも杓子定規に適用したことが根本にあり、法廷上の戦術や論理から不合理な量刑が科されたという問題です*2。当然、この事件によって、離婚後共同親権を見直そうとかそんな動きは全く見られません。

千田氏記事はその辺をミスリードさせようとしているようで、その点も非常に問題だといえます。
